Terms of business
FORMATION OF CONTRACT
All goods and services sold / provided by the Company (John Malik Ltd / Birmingham Foot Clinic) are sold subject to the Company's standard terms and conditions (as detailed below) which form part of the Client's (Patient / Instructing Firm) contract with the Company. The contract and duty of care is with the client, and not the client's insurance company. Hence the Client is liable for all costs incurred should a third party insurer not settle an account. It is the Client's responsibility to contact any provider of insurance to ensure that costs being incurred are covered in full.
The Company shall be paid by the Client within thirty (30) days of the date of invoice for services and goods, unless otherwise agreed in writing by the Company. In the event of late payment, the Company will charge an administration fee of £10 in addition to the amount outstanding. In addition, invoices unpaid for more than 60 days after the invoice date will incur a surcharge of an additional £20 (£30 in total) to cover invoice follow up, administration and debt collection services.
If any amount of an invoice is disputed then the Client shall inform the Company in writing of the grounds for such a dispute within seven days of the invoice being received. Once settlement of the dispute has been agreed, any sum then outstanding shall also be payable in accordance with these payment terms.
APPOINTMENTS, CANCELLATION OR NONE ATTENDANCE
The cost, without prior agreement in writing, for a new consultation is £180 and £160 for review. In view of the nature of the services provided, costs incurred for room charges and administrative support, a charge of £35 is made should a client not attend or cancel an appointment less than 24 hrs. prior to consultation / service provision. When an appointment is arranged a contract has been formed.
BIOMECHANICAL AND ORTHOTIC TREATMENT
The Company provide biomechanical examination, gait analysis and orthotics for clients as part of a treatment line. Many insurance companies do not pay for orthotic devices, most pay for assessment and examination. Insured Clients should confirm with their insurer what is and is not covered. Bespoke functional foot orthotics vary in cost, as a guide they are in the region of £175 - £225. Patients who are not insured will be offered an episode of care package. This includes assessment for orthotics, digital pressure scans, 3D optical scans / impressions, one set of orthotics, one modification if required (within 6 months from issue), fitting and review. Orthotic devices are guaranteed for a minimum of 5 years against shell breakage and 6 months against excessive cover wear. Orthotics do periodically need to be refurbished as they wear, this varies on usage and device type.
